Part A General
1 About Music Monkeys
Music Monkeys is a music centre for young children and their families, with a shop and online shop offering musical instruments, books and materials.

2 When these terms apply
2.1 These terms apply to group lessons, online shop purchases, private lessons, children's birthday parties and bookings by organisations. Part A contains the general provisions. Part B applies to group lessons, Part C to the online shop, Part D to private lessons, Part E to children's birthday parties and Part F to organisations.
2.2 The membership provisions in Part B apply only to group lessons. Separate arrangements are made for rentals and other individual activities. Specific arrangements concerning prices, dates, location and delivery are set out in the offer, quotation or booking confirmation.
2.3 These terms are made available to you in a form you can save before you complete your registration or order. By registering or placing an order, you agree to the applicable terms.
2.4 Individual arrangements that we confirm in writing take precedence where they differ from these terms. Your statutory rights as a consumer always remain applicable.
3 Personal data
We process personal data for purposes including registrations, the lesson portal, payments, orders and communications. Our privacy policy explains which data we process, why we process it and what rights you have. Registration or an order does not constitute general consent to publish identifiable photographs or videos.
4 Questions complaints and applicable law
4.1 If you have a question or complaint, please email info@musicmonkeys.nl and describe the issue. Where relevant, include the participant's name or the order number. We will respond within 14 days. If we need more time, we will let you know when you can expect a substantive response.
4.2 The agreement is governed by Dutch law. For agreements with consumers, this does not limit the protection provided by mandatory consumer law. Disputes may be submitted to the court that has jurisdiction under the law.
Part B Group lessons and trial lessons
5 Registration and trial lessons
5.1 Registration takes place through our Trainin lesson portal. The portal shows the current programme, fees, lesson frequency and available places. The first payment due is made immediately through the portal when you register. You will receive confirmation of your registration.
5.2 For group lessons, you can first book two paid trial lessons. The price is stated with the offer in the lesson portal. You can attend both lessons in the same group or try different groups or teachers, subject to available places.
5.3 Trial lessons are not automatically converted into a membership. If you wish to continue afterwards, you must register for your chosen membership yourself.
5.4 You can also take out a membership directly without attending trial lessons first. This reserves a place in your chosen group from the agreed start date. Booking trial lessons does not guarantee a regular place afterwards.
5.5 You can join during the lesson year as long as a place is available. If a group is full, you can enquire about another group or a waiting list.
6 Membership during the lesson year
6.1 Membership starts on the date agreed at registration and continues during the lesson year until you cancel it or the previously stated end date in the summer is reached. You do not need to register again for each series of lessons during the lesson year.
6.2 You attend lessons in the group for which you are registered. Lesson frequency varies by membership. Weekday groups generally have weekly lessons according to the timetable; Saturday groups have lessons twice a month on the stated dates.
6.3 The current timetable, periods without lessons and holidays are listed in the lesson portal. School holidays during the year do not end your membership. Membership ends automatically on the previously stated end date in the summer, without you needing to cancel it. A new registration is required to participate in the following lesson year.
6.4 Changing groups is possible by agreement, as long as a place is available in a suitable group. If the change affects the fee, we will discuss this with you in advance.
6.5 Membership and booked lessons are personal and cannot be transferred to another child without consultation.
6.6 As an alternative to a monthly membership, you can purchase an annual pass for the full lesson year from September through July. The full lesson fee is paid in a single payment at registration. The annual pass ends automatically on the previously stated end date in July. A new registration is required for the following lesson year.
7 Registration fee and music bag
7.1 When you register as a member, you pay a one-off registration fee of € 20,00. This fee is stated at registration and charged together with the first payment.
7.2 New members receive a Music Monkeys music bag containing instruments and materials for making music at home. The bag and the materials provided become your property.
7.3 No registration fee is charged if you only book trial lessons or individual workshops.
8 Lesson fees and payment
8.1 The fee, payment months, lesson frequency and start date are stated for the chosen membership before registration. All prices include any applicable VAT.
8.2 For parent-and-child lessons, the fee covers one child and one accompanying adult, unless the offer expressly states otherwise.
8.3 The monthly fee is a spread payment for the agreed lesson programme. It is not simply the price of the lessons that happen to fall within a calendar month. You therefore pay the same amount in each payment month, even if one month has more lesson days than another.
8.4 For programmes based on 37 lessons per lesson year, the lesson fees are spread over 10 payment months. No monthly payments for these programmes are collected during the summer holiday specified in the offer. For groups with a different lesson frequency, the arrangements stated for the relevant membership apply.
8.5 Your payment period begins on your membership start date and runs for one month at a time. For example, if you start on 5 October, your first payment period runs from 5 October to 5 November and you pay the full monthly fee. If your membership ends during a payment period, the lesson fee for that final period is calculated proportionally up to your membership end date.
8.6 When taking out a membership, you give a direct debit mandate for recurring payments. After the first payment, the monthly amounts due are collected automatically according to the payment arrangements you receive at registration.
8.7 Make sure your payment details are correct and sufficient funds are available. If a payment fails, we will let you know how to pay the outstanding amount. Any debt collection costs are charged only in accordance with the statutory rules and after the legally required payment reminder, which is sent free of charge.
8.8 Revoking a direct debit mandate or reversing a payment does not, in itself, end the membership. Article 9 applies to cancellation. Your statutory rights regarding direct debits remain applicable.
8.9 If you wish to use an Ooievaarspas, select the corresponding option when registering. The discount and required checks follow the current scheme. Bring a valid pass to be scanned at the specified times. We will discuss any consequences of an expired pass or a missing check with you before adjusting your payment.
9 Cancelling your membership
9.1 You can cancel your membership at any time with one month's notice. To do so, email admin@musicmonkeys.nl with your child's name and the desired end date.
9.2 The notice period begins when we receive your cancellation. You can cancel on any day of the month; you do not need to wait until the end of a calendar month. For example, if we receive your cancellation on 12 March, your membership ends on 12 April, unless you choose a later end date.
9.3 We will confirm the cancellation and end date by email. The date we receive your cancellation is decisive; termination does not depend on the date we send the confirmation.
9.4 You can continue attending lessons until the end date, and the corresponding lesson fees remain payable. The final monthly payment will be calculated proportionally where necessary. No amounts for new membership periods will be collected after the end date. Any outstanding amounts relating to the period before the end date remain payable.
9.5 Stopping attendance or reporting absence from individual lessons does not constitute cancellation of your membership.
9.6 The notice period does not extend your membership beyond the previously agreed end date in the summer. Membership ends automatically on that date, and no cancellation is required.
9.7 The annual pass is purchased for the full course period from September through July. The lesson fee is paid in a single payment at registration. The associated discount and additional benefits are conditional on purchasing the full course. The annual pass cannot be cancelled partway through the course. If you stop participating early, the lesson fees paid will not be refunded. The one-month notice period for monthly memberships does not apply to the annual pass.
10 Reporting absence and making up lessons
10.1 If you cannot attend, for example because of illness or a holiday, please report your absence through the Music Monkeys app or lesson portal. This makes your place available to someone wishing to make up a lesson.
10.2 Missed group lessons can be made up during the same lesson year while your membership remains active. You schedule a make-up lesson yourself through the app, in a suitable group with an available place.
10.3 Make-up lessons depend on available places. We cannot guarantee that a place will be available on your preferred day, at your preferred time or with a particular teacher.
10.4 Where online participation is offered, you can join the lesson from home through Google Meet. Information about this is available from Music Monkeys.
10.5 Lesson fees are not refunded for lessons you miss yourself. This does not affect your statutory rights if Music Monkeys does not provide the agreed lessons.
10.6 Unused make-up lessons cannot be exchanged for money and do not entitle you to an extension of your membership. The opportunity to make up lessons ends at the end of the relevant lesson year or when your membership ends, whichever occurs first.
11 Participation and supervision
11.1 At parent-and-child lessons, each child attends with one accompanying adult. If the usual adult is unavailable, another adult familiar to the child may attend instead.
11.2 Parents do not stay in the lessons for groups aged 4 to 6. For children aged 4 to 5 who still need an accompanying adult, parent-and-child groups are available, depending on the programme.
11.3 During parent-and-child lessons, the accompanying adult remains responsible for supervising the child. During lessons without a parent, the teacher supervises the child for the duration of the lesson. Parents are responsible for bringing and collecting their child on time.
11.4 Follow the teacher's instructions to maintain a calm and safe learning environment. Treat the instruments, materials and lesson room with care.
11.5 Let the teacher know in advance what practical support your child needs to participate safely. Share only health information that is relevant for this purpose.
12 Changes and cancelled lessons
12.1 If the regular teacher is absent, a substitute teacher may teach the lesson.
12.2 If Music Monkeys has to cancel a lesson, we will offer a replacement lesson. If we cannot reasonably replace the lesson, we will credit or refund the lesson fee relating to the lesson not provided.
12.3 Planned holidays and days without lessons that were included in the timetable in advance are not considered cancelled lessons.
12.4 If a group cannot start or continue, we will discuss a suitable alternative group with you. If we cannot offer a suitable alternative, you can end the agreement for the part not provided without charge. Any lesson fees paid in advance for that part will be refunded.
12.5 We will discuss any substantial change to the agreed lesson day, time or location in advance. If the change means you cannot reasonably continue participating, we will seek a solution. If no suitable alternative is available, you can end the affected membership without charge.
13 Changes to fees and terms
13.1 We will inform you in writing at least one month in advance of a proposed fee change or a substantial change to these terms. We will state the change, the reason for it and its effective date.
13.2 We will apply a fee increase to existing memberships only if there is a valid contractual or statutory basis for doing so, or if you agree to it. This provision does not give us unrestricted authority to increase fees unilaterally.
13.3 If a change is disadvantageous to you, you can end your membership before the effective date without additional charges. The change does not apply retrospectively to periods that have already passed.
14 Safety and liability
14.1 Music Monkeys provides a safe learning environment and ensures that lesson materials are used and maintained with care.
14.2 Do not leave valuables unattended. Music Monkeys is liable for damage, loss or injury only to the extent that it can be legally attributed to Music Monkeys.
14.3 Statutory liability rules apply to damage caused by a participant or accompanying adult. There is no automatic obligation to compensate for every instance of damage to lesson materials.
Part C Online shop
15 Ordering and payment
15.1 Product information and prices are available in the online shop. Before completing your order, you will see the total amount, including any VAT and delivery charges, and the available payment and delivery options. You will receive confirmation after placing your order.
15.2 Payment is made using the options offered at checkout. An online shop order is separate from a lesson membership and does not authorise monthly direct debits for lessons.
16 Delivery and collection
16.1 You can have your order delivered or choose collection from Music Monkeys. The collection address is Witte de Withstraat 28, 2518 CV The Hague. You can contact us to arrange a collection appointment.
16.2 Delivery charges and the expected delivery time are stated before purchase. Products on back order may take longer to arrive. A standard item that we order from a supplier does not automatically become a custom-made item as a result.
16.3 Unless otherwise agreed, we will deliver within 30 days. If delivery is delayed, we will inform you. Your statutory rights to an additional delivery period, termination and a refund remain applicable in the event of late delivery.
16.4 The risk of loss or damage during delivery remains with Music Monkeys until you, or a recipient designated by you, receive the order. The statutory exception for a carrier you choose yourself that we have not offered remains applicable.
17 Cooling-off period and returns
17.1 Online shop purchases generally have a statutory 14-day cooling-off period, starting on the day after receipt. If a single order is delivered in separate shipments, this period starts upon receipt of the last item.
17.2 If you wish to withdraw from your purchase, notify us clearly within the cooling-off period, for example by emailing info@musicmonkeys.nl. Preferably include your name, order number and the items concerned. You may use the model withdrawal form, but this is not compulsory.
17.3 Return the items within 14 days after notifying us of your withdrawal to Music Monkeys, Witte de Withstraat 28, 2518 CV The Hague. You can also return them in person by appointment. You do not need prior permission to exercise your right of withdrawal.
17.4 You may unpack and inspect a product as you would in a shop. If you handle it beyond what is necessary to establish its nature, characteristics and functioning, you may be liable for any resulting reduction in value, to the extent permitted by law.
17.5 Pack the product carefully in its original packaging.
17.6 You are responsible for the direct costs of return shipping if we informed you of this before purchase. For products that cannot be returned by regular post, we state the return costs or a reasonable estimate in advance.
18 Refunds
18.1 If you withdraw from your purchase, we will refund the amounts due within 14 days after your notification. We may withhold the refund until we have received the products or you have provided evidence that you have returned them, whichever happens first.
18.2 If you return only part of your order, the original delivery charges will not be refunded.
18.3 We will use the same payment method as for the purchase unless you agree to a different method.
19 Exceptions to the cooling-off period
19.1 The right of withdrawal can be excluded only on statutory grounds. If an exception applies to a product, we will inform you before purchase.
19.2 This may include products made to your specifications or clearly personalised products. It may also include sealed CDs whose seal has been broken after delivery, or sealed products that are unsuitable for return for health or hygiene reasons once the seal has been broken.
19.3 Not every instrument is a hygiene product. An exception is applied only where the statutory conditions are met. An exception to the cooling-off period does not affect your rights if a product is faulty or the wrong product is delivered.
20 Incorrect damaged or faulty products
20.1 You are entitled to a product that conforms to the agreement and to what you may reasonably expect of it. A manufacturer's warranty does not limit your statutory rights.
20.2 If you receive an incorrect, damaged or faulty product, contact info@musicmonkeys.nl. Describe the problem and, if possible, include a photograph. We will provide a solution in accordance with the statutory rules, such as repair or replacement free of charge and, where provided for by law, a price reduction or refund.
20.3 Music Monkeys bears the costs necessary to deal with a valid warranty claim. The standard return shipping cost arrangements for the cooling-off period do not apply to such claims.
Part D Private lessons
21 Registration and lesson arrangements
21.1 Private lessons take place weekly on an agreed fixed day and at a fixed time, or every other week if agreed. This time is reserved for the student. Lesson duration, frequency, price, start date and end date are agreed before registration.
21.2 Scheduled lessons are shown in your Music Monkeys account. A private trial lesson is booked separately and does not automatically lead to a membership.
21.3 The private lesson membership runs until the agreed end date during the summer holiday and then ends automatically. You must register again for the following lesson year. Early cancellation is possible under Article 23.
22 Lesson fees and materials
22.1 The first payment due is made at registration. Subsequent payments are collected automatically under your direct debit mandate around the 28th of the preceding month.
22.2 Lesson fees are spread over the agreed payment months. The monthly amount therefore remains the same in those months, even if a month has fewer lessons because of school holidays. The regular weekly annual programme consists of 37 lesson sessions between September and July, including the applicable Together in Music sessions, spread over 10 payment months. If lesson frequency differs, you will receive the corresponding arrangements in advance.
22.3 Monthly payments are not normally collected in July and August. If you join later in the lesson year, a proportionally adjusted amount may be payable in July. Payment-free months are separate from the dates on which lessons take place.
22.4 The teacher will discuss any required books, instruments and other materials with you in advance. Their purchase or rental is agreed separately. Keyboards can be rented; rental arrangements are recorded separately.
22.5 The provisions on failed payments and direct debit mandates in Articles 8.7 and 8.8 also apply to private lessons. The € 20,00 registration fee and music bag arrangements in Part B do not apply to private lessons.
23 Cancelling private lessons
23.1 You can cancel your private lesson membership during the lesson year with one month's notice. Email admin@musicmonkeys.nl and include the student's name and the desired end date.
23.2 Articles 9.2 to 9.5 apply to receipt, confirmation and the final payment calculation. In any event, membership ends on the previously agreed automatic end date if that date occurs earlier.
24 Reporting absence and cancelled lessons
24.1 If the student cannot attend because of illness, a holiday or another reason, contact the teacher as soon as possible.
24.2 The teacher may offer an alternative lesson time if there is space in their timetable. A replacement lesson is not guaranteed. If the student is unable to attend, the lesson fee remains payable and no refund is given if rescheduling is not possible. The make-up arrangements for group lessons do not apply to private lessons.
24.3 If Music Monkeys cancels a lesson, we will arrange a substitute teacher or a replacement lesson. If we cannot offer a reasonable replacement, we will credit or refund the amount relating to the lesson not provided.
25 Practising at home and Together in Music
25.1 The teacher will discuss suitable activities for practising at home. Regular practice helps the student progress. If the assignments are too much or practising is difficult, discuss this with the teacher so the approach can be adjusted.
25.2 Students of Elena Gelmi may be invited to Together in Music when they are ready. These sessions are included in the lesson calendar and carry no additional charge.
25.3 The provisions on changes and safety in Articles 12.5, 13 and 14 apply correspondingly to private lessons. Provisions that relate exclusively to group lessons do not apply to private lessons.
Part E Children's birthday parties
27 Enquiries and bookings
27.1 Send enquiries to romy@musicmonkeys.nl. Include your preferred date, location, the children's ages and the expected number of children. We will discuss the workshop, additional services and practical options, and check availability.
27.2 After confirmation, you will receive an invoice for the full agreed amount. The booking is final once payment has been received. The price, included activities and duration are stated in the booking confirmation.
27.3 A maximum of 12 children may participate.
27.4 A children's birthday party is booked for a specific date and time and falls under the statutory exception for leisure activities on a specific date. There is therefore no statutory cooling-off period.
28 Cancellation and rescheduling
28.1 Notify us of cancellation in writing at romy@musicmonkeys.nl. The time we receive your notification in relation to the agreed start time determines the refund below:
28.2 The amount retained relates to reserved time, preparation, teacher commitments and the limited opportunity to rebook the date. This amount will not exceed reasonably substantiated losses and costs. Costs saved and replacement income for the same reserved time will be deducted. This arrangement also applies in the event of illness or personal circumstances, to the extent permitted by law.
28.3 Rescheduling is possible only by agreement and after written confirmation. A request to reschedule does not automatically change the original booking.
28.4 If Music Monkeys cancels, we will discuss a suitable alternative date. You do not have to accept another date. If no replacement booking is agreed, we will refund the full amount. Any other statutory rights remain applicable.
29 Practical arrangements
29.1 The workshop is adapted to the children's ages. Additional activities, goody bags and material surcharges are agreed in advance.
29.2 If a party takes place at another location, the person making the booking must provide a suitable, safe space and access at the agreed time. The teacher brings the agreed instruments and materials.
29.3 Agree in advance which adults will be present to provide supervision and support. The person making the booking must provide relevant information, such as information about allergies, in good time. The safety and liability provisions in Article 14 also apply to parties.
Part F Lessons and workshops for organisations
30 Quotation and delivery
30.1 This part applies to bookings by libraries, childcare centres, preschools, schools and other organisations. The quotation or booking confirmation states the content, target group, dates, times, location, group size, price and any travel and material costs.
30.2 The booking becomes binding when the quotation is accepted or the arrangements are confirmed in writing. A departure from these terms applies only if we agree to it. Existing contractual arrangements are not automatically replaced by new terms.
30.3 The client must provide a suitable, safe space, access in good time, and the layout and facilities agreed in advance. Staff members or accompanying parents remain responsible for supervising the children; the Music Monkeys teacher leads the musical activity.
30.4 The maximum number of participants agreed in advance must not be exceeded. The client is responsible for monitoring this maximum, both during registration and during the activity. This also applies to drop-in activities: the client must monitor admissions on site and must not admit additional participants once the maximum has been reached.The maximum is based on the nature and format of the workshop, the supervision provided and the instruments and materials available. The teacher may refuse participants above this maximum and postpone the start or continuation of the workshop until the group size complies with the agreement. This does not entitle the client to a reduction in the agreed price. A lower actual number of participants does not reduce the agreed price either.
31 Payment
31.1 Payment is due within 14 days of the invoice date, unless a different period is agreed in the quotation or booking confirmation. We state whether the price includes or excludes any applicable VAT.
31.2 Additional work or materials outside the booking are charged only after consultation and agreement.
31.3 Before the booking begins, the client must provide all details and instructions needed to prepare and submit the invoice correctly. These include the correct billing name, billing address, email address for invoices and any project codes, cost centres, purchase order numbers or requirements for an expense or invoice submission portal.The client is responsible for providing this information in full and in good time, so that Music Monkeys can prepare the invoice correctly immediately after the booking has been carried out.
32 Cancellation by the client
32.1 Cancellation must be submitted in writing to info@musicmonkeys.nl. In urgent cases, the client must also contact the teacher or contact person directly. The time the written notification is received determines the notice period.
32.2 Music Monkeys schedules teachers several months in advance. The charge reflects reserved teaching time, preparation and the limited opportunity to schedule another booking in the time that becomes available. This arrangement also applies in the event of illness or absence of participating children, insufficient registrations or staffing difficulties at the client's organisation. Costs saved by Music Monkeys and replacement income for the same reserved time will be deducted.
32.3 For a series of booked lessons, the notice period is assessed separately for each cancelled lesson. Cancelling an entire series does not automatically make the full amount for all remaining lessons payable. The duration and notice period for an ongoing arrangement are agreed separately in advance.
32.4 Rescheduling is possible only by agreement and after written confirmation. Until then, the original booking and cancellation arrangements remain applicable. Any consequences for the fee are agreed in writing when the booking is rescheduled.
33 Cancellation by Music Monkeys
33.1 If a teacher is unavailable, a suitable substitute may be provided. If this is not possible, we will discuss another date.
33.2 No fee is payable for a lesson or workshop that Music Monkeys does not provide and for which no replacement has been agreed. Any amount already paid for that part will be refunded. Other statutory rights remain applicable.
